{"id":474,"date":"2025-10-19T12:45:10","date_gmt":"2025-10-19T10:45:10","guid":{"rendered":"https:\/\/ljubenko-i-partneri.ectoris.com\/en\/?post_type=case_law&#038;p=474"},"modified":"2025-10-19T12:45:10","modified_gmt":"2025-10-19T10:45:10","slug":"zabrana-prodaje-ne-sprijecava-zakup","status":"publish","type":"case_law","link":"https:\/\/www.ljubenko-i-partneri.hr\/en\/nova-praksa\/zabrana-prodaje-ne-sprijecava-zakup\/","title":{"rendered":"Zabrana prodaje ne sprije\u010dava zakup"},"content":{"rendered":"<p>Prema pravnom stajali\u0161tu Vrhovnog suda Republike Hrvatske br Revt 84\/06 privremena mjera zabrane otu\u0111enja i optere\u0107enja nekretnine u konkretnom slu\u010daju nije niti je mogla utjecati na pravo tu\u017eitelja da tu nekretninu dadu u zakup, odnosno da realiziraju ve\u0107 sklopljene ugovore o zakupu i ostvare korist, tako da \u0161teta koju tu\u017eitelji eventualno trpe zbog otkaza (odustanka) zakupaca od ve\u0107 sklopljenih ugovora o zakupu nije nanesena spornom privremenom mjerom. U prilog ovog pravnog stajali\u0161ta, kako to pravilno isti\u010de tu\u017eenik, govori i odredba \u010dl. 31. st. 1. Zakona o zakupu poslovnog prostora (\u201cNarodne novine\u201d br. 91\/96) prema kojoj zakup ne prestaje kad tre\u0107a osoba kupnjom ili po drugoj osnovi stekne od zakupodavca poslovni prostor, a \u0161to zna\u010di da je pravo otu\u0111enja odnosno njegova zabrana bez utjecaja na zakupni odnos.<\/p>\n","protected":false},"featured_media":0,"template":"","class_list":["post-474","case_law","type-case_law","status-publish","hentry"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v19.5 (Yoast SEO v19.10) -
