G\u017e 859\/2002 Sud prvog stupnja je odbijaju\u0107u presudu utemeljio u bitnome na zaklju\u010dku da iako izme\u0111u me\u0111usobnih davanja u objektivnom smislu postoji o\u010diti nerazmjer, tu\u017eitelj se nije nalazio u neskrivljenoj zabludi u pogledu stvarne vrijednosti prodane nekretnine, jer nije postupao s pa\u017enjom koja se u prometu zahtjeva, radi \u010dega nisu ostvarene pretpostavke za pobijanje ugovora temeljem \u010dl. 139. ZOO. Na o\u010dit nerazmjer mo\u017ee pozivati samo ona o\u0161te\u0107ena strana kojoj prava vrijednost predmeta ugovora nije poznata, niti joj je morala biti poznata. Radi se dakle u su\u0161tini o zabludi o vrijednosti, te je pored ostalog za pobijanje takove zablude potrebno postupanje s pa\u017enjom koja se u prometu zahtjeva (\u010dl. 61. st. 2. ZOO)..
