P-1865\/02 , potvr\u0111eno odlukom VTS RH P\u017e-6867\/02 tu\u017eitelj nema pravo na podno\u0161enje prijedloga za zabilje\u017ebu prvenstvenog zalo\u017enog prava radi namirenja tra\u017ebine. Odredba \u010dl. 72. Zakona o zemlji\u0161nim knjigama (NN br. 91 od 28.10.1996.godine) daje pravo vlasniku nekretnine i hipotekarnom vjerovniku da mogu zahtijevati zabilje\u017ebu prvenstvenog reda. Me\u0111utim, tu\u017eitelj nije hipotekarni vjerovnik pa slijedom toga ne mo\u017ee upisati zabilje\u017ebu prvenstvenog reda zalo\u017enog prava radi namirenja tra\u017ebine.<\/p>\n<p>Me\u0111utim, pod pretpostavkom da je tu\u017eitelj i ovla\u0161ten podnositi prijedlog i da sud upi\u0161e zabilje\u017ebu prvenstvenog reda zalo\u017enog prava, ista gubi u\u010dinak protekom roka od godinu dana od njezina upisa sukladno \u010dl. 74.st.1.
