Rev 602\/03 u ovom parni\u010dnom postupku pokrenutom hipotekarnom tu\u017ebom, u reviziji je sporno pravno pitanje, mo\u017ee li se, na temelju solemniziranog Ugovora o kreditu, koji predstavlja javnobilje\u017eni\u010dki akt i na temelju kojeg je u zemlji\u0161nim knjigama upisana hipoteka na nekretnini tu\u017eene, neposredno tra\u017eiti ovrha radi naplate osiguranog potra\u017eivanja.<\/p>\n<p>Odredba st. 3. \u010dl. 54. ZJB, u odnosu na odredbe st. 1. i 6. \u010dl. 54. ZJB, je lex specialis, jer se njome propisuju pretpostavke za neposredno tra\u017eenje ovrhe na nekretnini na kojoj je javnobilje\u017eni\u010dkom ispravom u zemlji\u0161nim knjigama upisana hipoteka, a o tome se u konkretnom slu\u010daju upravo radi.<\/p>\n<p>Prema odredbi st. 3. \u010dl. 54.
