Neosnovano se tu\u017eenik u reviziji poziva na odredbu \u010dl. 640. Zakona o obveznim odnosima, u smislu da bi na temelju te odredbe tu\u017eitelj bio u obvezi ishoditi uporabnu dozvolu za gra\u0111evinu iz \u010dlanka 4. Ugovora. Ovo iz razloga, \u0161to, s jedne strane, takva obveza tu\u017eitelja nije predvi\u0111ena Ugovorom, a, s druge strane, prema odredbi \u010dl. 131. st. 1. Zakona o gradnji uporabnu dozvolu pribavlja investitor.
