ZR prema kojemu sporazum o prestanku ugovora o radu mora biti u pisanom obliku. U ovom slu\u010daju, a suprotno tvrdnji tu\u017eitelja, sporazum je sa\u010dinjen u pisanom obliku. Naime pojam pisanog oblika pravnog posla ne zna\u010di nu\u017eno da je pravni posao napisan i potpisan u jednoj ispravi. Dovoljno je da jedna strana uputi drugoj potpisani prijedlog sporazuma u pisanom obliku, a druga strana u pisanom obliku prihvati prijedlog.<\/p>\n<p>Tu\u017eitelj je predao upravi tu\u017eenika molbu za sporazumni prestanak ugovora o radu koju je osobno potpisao 5. travnja 2005., a tu\u017eenik je prihvatio molbu i u pisanom obliku odlu\u010dio o prestanku tu\u017eiteljevog ugovora o radu sklopljenog na neodre\u0111eno vrijeme 1. listopada 1984. Time su radnik i poslodavac kao stranke ugovornog odnosa izrazile suglasnu volju za prestanak radnog odnosa i to ba\u0161 u obliku propisanom odredbom \u010dl. 104.
