Ugovora o zakupu, a i u smislu odredbe \u010dl. 21. ZZPP nakon prestanka zakupa zakupnik je du\u017ean predati zakupcu poslovni prostor u stanju u kojem ga je primio, a \u0161to tu\u017eenik nije mogao kada je prostor uni\u0161ten u po\u017earu nakon dvije godine vr\u0161enja zakupa.<\/p>\n<p>U takvim okolnostima, o\u010dito je da je do\u0161lo do nemogu\u0107nosti ispunjenja ugovornih obveza, za koju ne odgovora ni jedna od stranaka, sve u smislu odredbe \u010dl. 137. st. 1. ZOO-a, a \u0161to je imalo za posljedicu ga\u0161enje obveza kako tu\u017eitelja kao zakupodavca, tako i tu\u017eenika kao zakupca. Naime, prema toj odredbi kada je ispunjenje obveze jedne strane u dvostranom ugovoru postalo nemogu\u0107e zbog doga\u0111aja za koji nije odgovorna ni jedna ni druga strana, gasi se i obveza druge strane, a ako je ona ne\u0161to ispunila od svoje obveze mo\u017ee zahtijevati vra\u0107anje po pravilima o vra\u0107anju ste\u010denog bez osnova.<\/p>\n<p>U konkretnom slu\u010daju kako za po\u017ear u zakupljenom prostoru nisu odgovorni ni tu\u017eitelj ni tu\u017eenik, a zbog \u010dega je ispunjenje tu\u017eenikove ugovorne obveze u smislu vra\u0107anja lokala u stanju kakvom ga je primio postalo nemogu\u0107e, po\u0161to je lokal izgorio u po\u017earu, nu\u017eno je zaklju\u010diti da se time njegova obveza iz ugovora ugasila.
