ZOO).<\/p>\n<p>U konkretnom slu\u010daju tu\u017eenik prema tome nije u obvezi platiti temeljem ugovora. Ako je jedna strana izvr\u0161ila ugovor potpuno ili djelomi\u010dno, ima pravo da joj se vrati ono \u0161to je dala (\u010dl. 132. st. 2. ZOO). Tu\u017eitelj je ulo\u017eio rad i materijal u objekt koji je bio predmet raskinutog ugovora o gra\u0111enju, a u smislu te zakonske odredbe ima pravo zahtijevati da mu se nadoknadi vrijednost radova koje je izveo, ali ne u visini ugovorene cijene po ispostavljenoj privremenoj situaciji. Utvr\u0111eno je da objekt u dijelu u kojem je izgra\u0111en ima nedostataka i da su oni posljedica nekvalitetnog izvo\u0111enja radova, pa bi tu\u017eitelj imao pravo na naknadu u visini vrijednosti radova s nedostacima, a ne kao da je izveo radove bez nedostataka.<\/p>\n<p>Zbog raskida ugovora \u0161teta je mogla nastati i tu\u017eitelju i tu\u017eeniku (i jedan i drugi su istakli zahtjeve za naknadu \u0161tete), ali u smislu \u010dl. 132. st. 1. ZOO obveze na naknadu \u0161tete nije oslobo\u0111ena samo ona ugovorna strana koja je kriva za raskid ugovora.
