Rev-325\/2004 pogre\u0161an je pravni pristup drugostupanjskog suda. U smislu odredbe \u010dl. 63. st. 1. ZOVO radi osiguranja odre\u0111enog potra\u017eivanja nepokretna stvar mo\u017ee biti optere\u0107ena pravom zaloga u korist vjerovnika (hipoteka) Nov\u010dana tra\u017ebina je odre\u0111ena ako je odre\u0111en njezin iznos u novcu te vjerovnik i du\u017enik. Neko drugo njezino svojstvo, osim odre\u0111enosti, ne utje\u010de na mogu\u0107nost ili nemogu\u0107nost osiguranja zalogom, pa nema zapreke da se osigura i budu\u0107a tra\u017ebina ili uvjetna tra\u017ebina. Drugostupanjski sud se poziva i na pravno pravilo iz paragrafa 14 biv\u0161eg Zakona o zemlji\u0161nim knjigama nalaze\u0107i da ono dopu\u0161ta zasnivanje i upis hipoteke za tra\u017ebinu koja se odnosi na \u010ditav iznos odobrenog kredita kada \u010ditav iznos jo\u0161 nije iskori\u0161ten, ali i u tom slu\u010daju pretpostavka je da je kredit ve\u0107 odobren u trenutku zasnivanja hipoteke. U stavku 2. toga paragrafa odre\u0111eno je, me\u0111utim, da u takvom slu\u010daju treba u ispravi na temelju koje se vr\u0161i upis navesti \u201cnajvi\u0161i iznos, koji kredit ili odgovornost smije dosti\u0107i\u201d, a to ne podrazumijeva da iznos kredita mora biti to\u010dno odre\u0111en u trenutku zasnivanja hipoteke, odnosno podrazumijeva da nije odre\u0111en s obzirom na to da se tra\u017ei da se u ispravi navede najvi\u0161i iznos \u201ckoji kredit smije dosti\u0107i.
