P\u017e-4590\/05 dru\u0161tvo koje je u visokoj financijskoj blokadi i koje je ve\u0107 imalo vjerovnike sa dospjelim potra\u017eivanjima, a pri tom tre\u0107em daje u zalog nekretnine radi osiguranja potra\u017eivanja tre\u0107eg prema njegovom vjerovniku i time pristaje na prodaju svojih nekretnina radi naplate toga potra\u017eivanja tre\u0107eg prema njegovom vjerovniku, svjesno remeti ujedna\u010deno namirenje vjerovnika. Stoga je bez u\u010dinkaprema ster\u010dajnoj masi sporazu,m o osiguranju nov\u010dane tra\u017ebine kojim je preneseno zalo\u017eno pravo na vjerovnika iz tog sporazuuma.
