Revt 113\/04 iz izvatka iz zemlji\u0161nih knjiga ne proizlazi da je zalo\u017eno pravo radi osiguranja potra\u017eivanja tu\u017eitelja ste\u010deno i na kamatama, kao sporednom potra\u017eivanju, ve\u0107 samo na glavnici u visini od 73.108,70 DEM.<\/p>\n<p>Tu\u017ebeni zahtjev, koji je prihva\u0107en pobijanom presudom, uzeo je u obzir i narasle kamate, jer iznos od 713.464,69 kn, za koji iznos se tra\u017ei prodaja spomenute nekretnine radi namirenja potra\u017eivanja tu\u017eitelja, prema\u0161uje svotu od kunske protuvrijednosti 73.108,70 DEM, samo za koji iznos je uknji\u017eeno zalo\u017eno pravo, a ne i na kamate na taj iznos.
