Rev-1227\/07 odredba predmetnog ugovora o prijenosu zalo\u017enog stana u vlasni\u0161tvo prednika tu\u017eiteljice je ni\u0161tav u smislu navedene zakonske odredbe \u2013 \u0161to zna\u010di da ne proizvodi pravne u\u010dinke.<\/p>\n<p>Tako\u0111er, treba dodati da se prema odredbama ZV (\u010dl. 115. st. 1. u vezi s \u010dl. 120. st. 1. ZV) vlasni\u0161tvo nekretnine na temelju valjanog pravnog posla stje\u010de tek upisom u zemlji\u0161ne knjige, pa pravni posao (ugovor) predstavlja samo jedan od konstitutivnih elemenata za stjecanje vlasni\u0161tva (titulus).
